Hi

I ordered some Octozin from a seller on Ebay about 3-4 weeks ago (25 November to be exact) and it still hasn't arrived. He says he posted it on 26 November and is blaming the delay on the snow and royal mail experiencing serious delays. The thing is I've bought and sent things since this and all have arrived in normal (for December) time.

I've now emailed him twice saying that I think it's got lost in the post or something and all I get is more waffle about the snow. Does he have a responsibility to send me another one or is it basically my tough luck if I don't get it?

If you paid through paypal make a claim and let them sort it.

Yeah I did. Can I claim the money back through them then?

What`s the Sellers feedback like?

The onus is on the Seller to provide proof of posting/tracking number. Despite the weather being an inconvenience and causing postal delays, after 21 days I would personally say you`ve given him an appropriate length of time for the item to have been delivered by now.
If it was me I`d email the Seller stating that unless he can provide proof of posting then you will have to open a dispute with ebay/paypal under their guidance of 'item not received'

IF he can`t provide proof of posting it`s unlikely to go in his favour but that`s the risk a Seller takes when items don`t arrive. If you do open case with ebay/paypal be very, very polite and show yourself to be extremely accommodating and understanding of the weather situation, they`ll probably look at all correspondance between you and the Seller.

That`s my two penneth anyway ;)

Put a dispute/claim in and they will liaise between you and the seller to try and resolve the issue, if the seller doesn't respond or has no legitimate reason as to why it never arrived paypal will usually request a replacement sent out or recover the monies for you.

where is the seller based, as if he is saying that there is a delay with postage then it may be true depending on where it is coming. Some areas of the countr have a 3-4 week backlog of post that is going to sit there for weeks. New post gets priority over old post that the RM has already been fined for as being late.

Ok thanks everyone. I've emailed him again to give him once last chance. I just get really annoyed at getting fobbed off. I don't even want my money back, I just want him to send me another one :(

Thanks, that's handy to know. I actually do believe that he sent it and I don't wanna be mean but I don't want to lose out either.

All i can say is, if he cant prove it arrived, you will win the dispute. no matter what he tells you. until you have the item, in your hand, its his responsibility, not yours. and if he gives you trouble sorting it out. give him bad feedback.

I've also found out that you can actually get proof of posting for ANY royal mail service for free. I've gotta say if I was an ebay seller this is something I would make sure I got. That way at least you can proove it's been posted then.

The only problem with the seller sending a new one is that if they have posted then eventually it will arrive with you (presuming it's just stuck in the backlog), so the seller will completely loose out despite having done nothing wrong.
But at the same time presumably you ordered octozin for a reason so could really really do with having some now... not when it eventually comes through.

yeah good point, they told me about this the other day. still, even if he has one. the item still needs to arrive, with the buyer. else, you get a refund. unfortunately for the seller, it's between him and the Post Office, to sort out.

I had a similar expereince and it could well be the postas it was in my case.
About 5 weeks abo I ordered some dechlorinator from an Ebay Powerseller with over 1900 positive feedback. It never arrived but he sent me proof of postage. Eventually he sent me a replacement as I needed it urgently and it arrived 3 days later. The original parcel still hasn't turned up.

He emailed me back this morning to say he would get straight onto Royal Mail to see what had happened to it.......he hasn't emailed me since though. :grr:

and yeah I do kinda need it lol. I really think that internal parasites could have been my problem all along so I want to treat asap.

It's too late for Jay (my neon platy) though :(

I hope you get this sorted.

Where is the item location?
I know the North of England have been having problems, big problems and I do know a friend who is still waiting for her parcels to arrive and she ordered around the same time as you too.

Paypal should refund you, if the seller is a good seller they would send another to avoid negative feedback ratings..

Talking of feedback, what's his like?

It's not bad, it wasn't 100% but I think it was like 98.5%. I can't remember the location though.

Has the seller actually stated that he has a tracking number for the item?

I personally think you`ve given him long enough now and if it were me I wouldn`t take any more excuses from the seller, I`d now open a dispute for 'item not received' , but that`s just my take on it.
