Don`t let one bad experience put you off buying online RK

Personally I`m surprised at the reply and offer you`ve had because out of all the fish I`ve bought from there I`ve not once had any reason to be dubious or complain, everything has been very spot on. I`ve even bought from Kesgrave without going through ebay and still never had any problems.

Obviously I was wrong about giving the Apistos a few days to see if they colour up a bit as they quite clearly haven`t. Sorry that you feel so crap about it all even though it`s understandable.

Yeah he said to me he knows nothing about colour strains and they were sold to him as super red. But even so, if he can look at the fish and spot "yeah thats not red".. then you don't sell it as super red.

I just feel ripped off and annoyed, as I was waiting months to get the cockatoo's.

Did you buy them from a "Buy It Now" listing? If so, you have the right to cancel the contract within 7 days of delivery, and get a full refund. Also, you said you were waiting months for them - is this months in between you placing your order and receiving them? If so, the seller has an obligation to complete the contract (ie deliver the fish) in 30 days or less. If he doesn't then you are again entitled to a full refund, including delivery charge. The seller may not charge you any cancellation charge or restocking fee. However, you are obliged to keep the goods safe, and to pay for return postage.

This doesn't count if the fish were from an original type Auction listing.

See The Consumer Protection (Distance Selling) Regulations 2000. Obviously, there's more details to it than that, and I'd suggest a trawl through Google for more details.

The grey area now comes as to whether the seller is in breach of contract - which it seems to me he is. If you ordered Red Fin Cockatoo Cichlids, and received Orange Fin, then the seller is in breach of contract, and is obliged to pay for return postage, under the Sale of Goods Act. Your only obligation is to keep them safe until they are despatched back to Kesgrave.

Another thing to note - it appears Kesgrave have no items listed on Ebay currently (assuming the seller id is "kesgrave"). From what little I've read about this seller on a few threads, it seems he is (or was) a serious player. Therefore, to have no items listed starts to ring alarm bells in my head.

Don't be put off buying online! I have only once had a similar experience to you (with coral, also off eBay) and I have bought & sold 1000s of fish via the interwebs. I think you have just been unlucky!

Perhaps this is a one off misunderstanding. Seems most people have had a good experience buying from them.

He has some red Angels listed which I am intrigued by.

Thats what i assumed, plus if they were the fish actually as advertised, then they would have the full red fins, as advertised. But they don't. And I can't see them changing from 80% yellow fins to 100% blood red fins.

Therefore Kesgrave tropicals has ****** me off, sold me bad colour strain fish, false advertisement, and only offered a puny £6 store credit as a sorry.

My first ever online dealing and it's gone like this. Well done kesgraves for putting me off buying fish online

Must agree Kesgrave have made a mistake but as elisew said, don't let this put you off, instead, next time, ask for a photo of the actual fish
