External filter outlet

I have treated my aquarium to a new external filter , the tetra ex800. The instructions said that the outlet bar should be above the waterline. However given the nature of the tank I physically can't do that. Is there any reason why the outlet can't be underwater?

The last time I had a quality external filter, it was to prevent the possibility of water syphoning back, in the event of a filter failure, (in the event of a powercut, for example).
