I recently bought a 35 gallon tank of craigslist and it came with a really old heater and filter prob 06 or old.

thinking I should replace both but want to spend under $60 for both, prefer closer to 40.

(the old filters completely dried out so it won't have bacteria on it)

Thinking maybe an aquaclear filter cuz I have once ob my 10 gallon and it works great

You can try to use the old filter and heater, but it would probably be better to replace them. I used the old filter and heater that came with my craigs list tank. I ended up replacing both in the end.

Yeah I'm worried the heater could go crazy and cook everything.

A Marineland Penguin 200 should work very nicely in that size tank...

AquaClear line is probably our most recommended for low-cost HOBs and the reason is that the media trays are wide open rectangular spaces that allow you to customize what media you want at a given time. They are simple and straightforward. They will probably not remain dead silent like an Eheim or that class of filter but they can be pretty good on the noise scale.

Heaters are heaters, unless you want to go external to keep your aquascape more natural but you've indicated you want to budget so externals are probably out of the picture. Always use a separate thermometer as part of your overall heating system. The little cheap spirit thermometers are fine - just take one from the batch that are all reading the same temp in the LFS.

I don't need it to be silent just not louder then the tv in the room. And I do have a separate thermometer already.

I'm sure the TV can hold it's own
