No it is not cruel at all. It would actually be even more cruel because it would hurt your overstocking. Nice job on raising the oxygen levels though.

about my overstocking what fish from my main tank can get removed and puth with my male betta in a 20l 40cm lenght 30 height 17 width

20L is pretty small so not many You could probably get away with MAYBE moving the two platies but that's about it.
