Dead Fish Upon Arrival

Hi' there,

I orderd some torpedo barbs of aquarist classified, the user sent them via apc and they turned up today but theyre all dead. there's 6 in total that come to £85. I havent got a response from the person yet but i'm just wondering if i should expect all the money back? Basically he had them advertised for £65 and if deliverd an extra £20, not having had DOA fish before should i expect the money for the fish and the delivery back or just the fish ? I havent personally seen the fish yet as the gf's waited in for them but he posted them yesterday so presume they were not packaged very well.

You should expect fish to arrive alive. I would take pictures as soon as possible, with the fish still in the shipping container, and start a dialog to have the money returned. You can probably expect to have to pay for shipping again if the person offers to replace the fish but they ought to stand behind the fish themselves.
 
Hi, take phtos of the dead fish in the packaging to prove they were DOA & email them to the seller.
I received a dead coral last week & got a full refund inc postage.
What is their DOA policy?
 
This doesnt sound like a scam or anything. Try to email the seller asap, hope you can both come to a mutually positive conclusion.
 
They're off a normal user not from a shop , he only had 6 so i got them all so he wont be sending anymore , so should he refund the delivery as well or just the fish ?

I've told the mrs to leave them how they are the in container/bag whatever they turned up in.

gutted really as i've fancied some of these for a wile.

Note** i'm not saying the user is a scammer or anything , just wanting to check what i;'m kinda entitled to request from the person
 
That is a difficult thing to deal with mate, as i have said about posting before i will post but its at the risk of the buyer, check the post to make sure he/she did not place this aswell....One thing is its difficult to gauge because if someone spent 60+ pounds and my fish arrived dead i would feel so guilty and probally allthough i said wouldnt i would refund,so don't go in all guns blazing but use your soft side to win the payment back...odd how all died,were they double bagged individually?
 
You are of course entitled to seek any compensation that strikes you as fair, but it is fairly common to refund only the fish themselves, not shipping. At least that is the stated policy of many of the on-line commercial vendors. This being a private party, you may run into some resistance to do that.

No idea how they're packaged as im yet to see them , dont finish work until 2pm, the GF said she took the first bag out and said the fish didnt look very bright coloured then noticed it was upside down and not moving ,s he checked the others and theyre all the same. She's just sent me a pic now and there isnt an awfull lot of water in the bag s probs lack of oxygen or water quality .
 
As has been mentioned you should check the original advert to see if there was any information pertaining to buyer's risk.
How did you pay? If you paid by Paypal then they may help you. You paid for live fish, and live fish didn't turn up. Paypal might help you on that front.

However, as a first course of action you should contact the seller and explain what has happened. See where that gets you initially.

He emailed me back asking if i should contact the courier ? presume as long as the courier gets it deliverd before 12 and the packaging intact that they do not have to pay compensation?

As others have said make sure a picture is taken asap, and if the seller does refund some money to you, it will more than likely be the cost of the livestock, not the postage.

I should imagine that is the case. The courier have upheld their part of the deal in delivering before the stated times. It would be nigh on impossible to prove any negligence on their part anyway.
 
Just got home and took a look at them they're perfect looking (apart from being dead upside down) but the bags are freezing! death by slowing freezing must be horrid, there was like one heat pack in there.

As for the advert its no longer on aquarist classified.
 
Asked him for the money back on the fish , if i dont get it i'll go through paypal, the packing was good apart from only having one heat pack. Negligance really , in this weather its pretty much freezing in the night so one heat pack for 6 fish is pretty poor, would of done well to last a few hours if that.
