40g is too small for even 1 Oscar, would be ok as a short term tank - 3-6 months but no longer. Even so you'd need extreme filtratation and a bigger tank asap.

Petco and Petsmart usually sell small ones because they don't have room for the bigger ones. That's where I got my Oscars and they were tiny!
