Stunted Red Devil Acting Weird?

I know the tank size is..... well TERRIBLE. I know they need a 75 gallon tank and can be up to 14 inches long if given proper care.
 
I have a red devil in a 10 gallon tank. I bought the tank seccondhand, and my friend was going to take the cichlids, but plans changed last minute. They have been here for a day now, but in the tank for a year.
 
 
He acts weird to me. The yellow lab is normal and swimming nice but the red devil just sits there, goes lopsided, sometimes gos up to the air for a breath, and is always flaired up.
 
Im looking to rehome him but parents arent on board yet.
 
Is this normal behaviour for a stunted fish?
 
 
Everything cycled correctly?
The lopsided behaviour is never good..
Is he gasping at the surface a lot?

The guy I got it seccondhand from changesnthe cadtridge two weeks ago so Im doing a fish in cycle. Im changing the water everyother day, as I dont have a test kit.

He is pretty much lopsided all the tike, but has only gone to the surface once that I have seen.
 
Every other day might not be enough to keep on top.
Is there an LFS you could take a sample to, to have it tested?
 
Could you take a picture of the lopsided-ness?
Screams to me; swimbladder but..
 
Hes actually a lot better today, eating more and swimming around. I havent seen him go to the top except for food all morning, but he still stays flaired pretty much all the time. It might be because the glass is reflective, and red devils are an agressive fish
