I just bought two male guppies yesterday and set up a one gallon aquarium kit that came with a pump and a hood with a light. Yesterdsay they both were very active i had their light on for a few hours..they ate and then i turned the light off last night before i went to bed then in the morning i went to work all day today and just now at 11 pm turned their light back on for a little while..my one guppy keeps acting very sluggish and breathing at the top of the water and wont leave the top of the water in his tank..his brother is eating and swimming around no problem..can someone tell me is he sick or what?

well im assuming you set the tank up the same day you added the fish??? the way you said it made it seem that way, if so:

for one thing if this is the case then your tank isnt cycled yet.

more info is needed

do you have an air pump, filter, de-chlorinator?

BTW guppies arent tolerable to rough temp, NO3, NO2, and ammonia levels.

i had too many nitrites in my already stocked and cycled tank and added some, half were killed off by the shock of entering a high nitrite tank

yes i put them in the same day...i let the tank frun for a lil while..i do have a pump so im ssuming thats what filters the water..and the other guppy is completely fine swomming fas and strong and eating well..its the other one that just keeps hangin out at the top..

Is the surface of your water being agitated?

Sounds to me like he's gasping..

Just a question.. Is one guppy bigger than the other? If so, sf the smaller one the one at the top all the time?
