Does This Sound Like Mouth Rot?

so i brought 3 new hearlequin espei yesterday, today i noticed that one of them seems to have his mouth open permanently, his bottom jaw looks a little white around the edges, and the top and bottom jaw lines do not meet properly to form the streamlined shape, its almost as if theres a little part of his top jaw missing but im not sure, i cant identify if its some kind of disease or not :(
 
It doesn't really sound like mouth fungus but some kind of malformation. In either case I'd take it back to the LFS right away.
 
when i went to the shop i asked the guy for 3 in a tank full of them, so i couldn't really check them out and choose which ones because he just netted the ones he could and i didn't get to see them till i got home as i didn't want to disturb them while they were in the plastic bags so i had to wait, then i only noticed today. thanks for your help anyway. if i take it back should they replace it for me ? or will they just give me my money back ? i've never took anything back before lol :)
 
hmmm just got home as i was visiting a friend. quickly checked my tank and had a count of the fish, then found one of my harlequins at the bottom of the tank dead :( had a closer look at it and it seemed to have a hole going through its bottom jaw, dont know what the cause of its death was though as i wasn't around to see what was going on at the time.
