not yesterday but the day before my heater boiled my fish, and my cousin put paracetomol in my tank, killing my fish :-(

i didnt know there could be compensation for things like that,
take it u didnt tell them about the paracetamol

LFS told me to email juwel for compo

Truck, Juwel will probably tell you to take it up with the store where you bought the heater.

Under 'The Sale of Goods Act 1979', your contract is with the shop, not Juwel. The shop are legally obliged to sort the matter for you, and they need to take it up with Juwel, not you.

Don't let them palm you off (that doesn't sound right, but no jokes please  ). Seriously though, lots of retailers try to divert you to the manufacturer to get out of their legal responsibilities, but they're not allowed to by law.

Cheers :good:

Heres a good link to 'Which' website explaining your rights under the act.

If you want some more in-depth reading, heres the full act in all its glory.

The main thing you need to consider is whether it is more or less than 6 months old. If its less than 6 months, the onus is on the retailer to prove that you caused the damage or it was caused by reasonable wear and tear. If its over 6 months old, the onus is on you to prove the damage was caused by an inherent fault.

Good luck. Let us know how you get on. Remember, they have no right to refer you directly to the manufacturer. :good:

it was two months old, and i bet theyll test it and it works knowing my look but they swapped it now, and i have no proof anymore that it was me :( thanks for the links i will show it them.

I didn't realise they had already replaced it. Good on them, that is what they should do. :good:

I'm not so sure where you stand on getting compo now if you don't have any proof anymore. Maybe best to e-mail Juwel on that point and see if you get anywhere. They might just tell you to get lost though............
