Problem With Lfs ! Suggestions?

Hi, I bought an aquaone 40 (55l) tank a week ago, it was a replacement for an older more established tank and what I did was transfer everything I could into this, ceram balls and filter sponge included as well as all the water I already had so I didn't have to do a fish less cycle as I needed to move my community asap. Well, one week in and I come downstairs to find a huge crack in the backing and a bit of plastic floating around, fish have swum into the back section to have a nosy round which is annoying as fishing them out of there is a nightmare. I have wedges it back into place but am so annoyed that now I have to take the tank back and get it replaced. Pets at home are willing to exchange it over with no issue but my issue with this is I have set up my tank exactly how I like it, even the substrate I won't be able to get the same because it's sand and gravel and I'll have to mix it to get it out also moving my community into a large trug bucket Is a huge risk and I'm worried I'll lose some! As you all know tropicals are not expensive but not cheap either! I will have to move...

5 minnow (yes I know cold water, shop sold them to me wrongly and I've had them over a year they are ok)
2 5 banded barbs
1 bristle nose plec
3 Yamato shrimp

Along with 2 moss balls and 3 live plants.
Do you think it's too much to say to the LFS that I want a partial refund too for all this inconvenience caused by their tank? As I'm going to be out of pocket and valuable time sorting all this out , not to mention the petrol it's going to take going to the store and back (it's not particularly close)

So long as you have the original receipt, I'd call, let them know what was going on and make sure they have a replacement one in stock as you would like an exchange

It wouldn't hurt to ask, I suppose, and having a few tears and a sob story would probably go further than getting angry.   IME, folks are more apt to help a damsel in distress as much as they can, as opposed to an irate maniac.  
 
But, honestly, I wouldn't get my hopes up on the partial refund.  The store isn't responsible for failures of the materials they are selling.  
 
It sounds like an issue with the manufacturer - and I'd buzz them to see what they can do for you.  I had an issue years ago with Marineland and they were very helpful.  But, the costs of shipping a filter and filter parts is far lower than shipping a tank.  
 
It doesn't hurt to ask, but don't expect anything. The store is not responsible for a manufacturing defect. Anything that they might do for you is above and beyond the call of duty. If they do anything for you, sing their praises from a convenient rooftop or write a glowing review in Yelp or someplace similar.
 
Update! They replaced my tank, I didn't include thepowerhead, heater.and filter foam as I kept them for my fish while they were in a temp home, but they just replaced the whole lot which was great, means I have a spare power head, spare heater and spare foam, carbon filter and ceram balls, and they even gave me a £20 gift card, so as far as singing their praises I can't mention their name on here apparently? But my review of them is glowing, they were very helpful and I shall go back and spend the £20 soon on a new tank mate ;) x

I'm not sure about the rules, but there are many threads out there that mention store names and brand names. Advertisements are frowned upon but recommendations, or not recommended, are most likely allowed.
