Hi I just want to know if this is a clown pleco because I’m pretty sure it is, he/she extends her/his top fin when eating but the only picture I could get of that is the last photo that isn’t clear (sorry for poor photo quality he/she is a bit shy) but if it isn’t please let me know what fishy this is

It doesn't look like a clown pleco (Panaque maccus) to me.
It looks like a juvenile common pleco (Hypostomus Plecostomus), which grow to 18-24inches long.

100% a common plec. Clown plecs have defined stripes and the body shape is different.

Look like a common pleco, they need a bigger tank...
 
The petshop doesn’t take animals back, what can I do? I can’t get a bigger tank because I don’t have a place for a bigger tank
Argue the fact they sold you a common pleco as a clown pleco, they misrepresented their product and it isn't suitable for purpose (i.e: I normal size home aquarium).

We did they just said we have no proof because on the slip it only says fish so we can’t do anything or take him back
 
Yeah thats a common pleco.

Unfortunately they need a massive tank when they grow and produce a lot of waste. Looking at over 200 gallons or 757 litres.

Best bet is to source a rescue or perhaps look to rehome him to a local.

And avoid that shop, sounds sleazy :(
