This morning my betta was on it's side at the top of the tank. He didn't move until 1 min after I saw him like that. He's been acting normally and is eating. Iv had him for one month and I've noticed that he often swims sideways ever since I got him. He lives in a 5 gallon filtered and heated tank. So is he ok?

He's fine. Bettas are lazy and like the lay on the floor when they sleep. Mine do weird things like that all the time. You might get some real or silk plants with large leaves so he has a hammock
If he stops eating or moving completely then you may have a problem. In which case, do a water changes daily. If he looks like he is having problem breathing, then give a 10 minute salt bath (freshwater salt, 1 tsp per gallon)
