My electric yellow is pregnant and at the moment she is by herself in a 10 gallon tank.
I am using I think a 40++ filter for the 10 gallon tank.

Should I worry about my frys getting sucked and soon die inside the filter?

I don't exactly know what a 40 ++ filter is but my advice would be, if you are concerned about the fry being cobbled up by the filter, wrap the area of the filter with the intake with filter floss. You can use an elastic band to hold it in place. The other thing you might have to watch out for is the strength of the current created by the filter. If its very strong the fry will all end up bunched in a corner or be spinning around in an eddy in the tank. To prevent this, point the filter output directly at the wall of the tank so most of the energy is dissipated/absorbed by the tank wall or add large objects that will create areas of still water.
 
I`m guessing you mean a Fluval +4 internal (1000lph) ???

Tanks suggestion is spot on, I`ve also heard of people using tights over the filter intake.
