I really can't tell anything from the pics. Why do you think he/she might be ill? What symptoms are you seeing? What lives in the tank with the snail? What are you water parameters?

some sword tails and some others not sure what they are called, 2 more snails and 1 shrimp and 2 pleco's, not sure really what symptoms but it has a shell that is darker to the other 2 not yellowish and looks a bit old and looks like a hole is starting to appear on his back... also is it natural for them to just sit upside down? cause thats what he seems to do and not move for a little while?

I don't know alot about snails, but I do know if there is a hole starting in the shell, that's not good. It's lacking calcium, I think. But you should wait for someone who knows more about inverts.

If it's upside down, is it dead? Does it move around at all?
