Hi all! I'm looking to get back into the frog game and want to start with a tadpole. These are black and I'm assuming they are toads rather than a frog. is that plausible?

There's no way of telling whether black tadpoles are from a frog or toad. You have to let them grow up and metamorphose into whatever.
We have black tadpoles from frogs in Australia.
 
In North America, swarms of tiny black tadpoles in shallow water, such as depicted in your photo, usually are toads. If you decide to raise a few and find out, they should never be released.
